Why Local Government and Police Need to Resist Covid-19 Tyranny

On May 8 I made a call to the SLO County Board of Supervisors meeting regarding agenda item one: “Update on COVID-19 in San Luis Obispo County and direction to staff as necessary. All Districts.” I only was able to say just a small part of what I wanted to say, and what follows is what I said and what I left out. I reference Governor Newsom of California here, but it applies to many other Governors and State and Federal (so-called) authorities.

It is the local, not state, governments that have the authority to oversee the details of health policy, for only they know their people and the idiosyncrasies of their local community. They know what’s best, not the governors! It is a violation of the principle of subsidiarity for a larger agency to take over the role that a lower agency can do better and is charged with direct oversight. Of course, all these lockdown edicts egregiously violate obvious God-given human rights, as well as constitutionally protected rights. The Constitution is the master law of the land, and the natural moral law is an even higher legal authority. As St. Augustine said, “An unjust law is no law at all.” In the face of unjust laws, prudence sometimes dictates civil disobedience. Prudence dictates this right now.
